Texas Consumer Data Privacy Notice

Applicability

This Privacy Notice is provided pursuant to the Texas Data Privacy and Security Act (TDPSA). This Notice applies to Texas residents who are acting only in an individual or household context.  Such Texas residents, called “Consumers” in this Notice, have certain rights when they disclose their Personal Data or have their Personal Data disclosed to Federated Mutual Insurance Company (Federated, We).  These rights only apply to Consumers who are making 3rd party claims against a Federated insured.   These rights do not apply to Consumers acting in a commercial or employment context (for example: workers compensation claims, employee benefits claims, disclosures related to business, etc...).  They do not apply to Life/Disability insurance provided by Federated.  Other exceptions apply under the TDPSA.  Federated Insurance is a “controller” under the TDPSA and processes Personal Data.  Any other terms defined in the TDPSA have the same meaning when used in this Privacy Notice. 

“Personal Data” means any information that is linked or reasonably linkable to an identified or identifiable individual.  It does not include:

  • Deidentified data or publicly available information.
  • Health records.
  • Protected health information under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
  • Data covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), the Driver’s Privacy Protection Act of 1994

The purpose of this Notice is as follows:

  • To provide Consumers with information on the categories of personal data Federated processes;
  • Describe purposes for which We process the personal data;
  • Describe the rights Consumers have under the TDPSA; and
  • Explain how to exercise those Consumer rights.

Categories of Personal Data Processed by Federated:

  • Non-public personal data that a Consumer provides to Federated in order for Us to investigate and handle a claim.  This may include, for example, name, date of birth, address, e-mail address, telephone number, financial information, medical information, or recordings of phone calls or messages left on a Federated phone system.
  • Sensitive personal data.  Namely, mental or physical health diagnosis, subject to a Consumer signing a consent form, allowing Federated to process the claim.

Federated’s Purposes for Processing Personal Data:

  • We process Personal Information in order to investigate, process, negotiate, and pay or defend against claims brought by Consumers.  
  • Perform other internal operations that are reasonably aligned with and anticipated as part of Federated’s interactions with a Consumer.
  • Engage in other activities that are incident to or otherwise compatible with the provision of services requested or the performance of Federated’s obligations.
  • Comply with Federal, state, or local laws, rules or regulations. Comply with civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, local, or other governmental authorities.
  • Investigate, establish, exercise, prepare for, or defend legal claims.
  • Conduct internal research to develop, improve, or repair products, services, or technology.
  • Prevent, detect, protect against, or respond to security incident, identity theft, fraud, harassment, malicious or deceptive activities, or any illegal activity.
  • Other lawful purposes.

Consumer Rights:

  1. Right to confirm whether Federated is processing the Consumer’s Personal Data and to access the Personal Data.  
  2. Right to correct inaccuracies in the Consumer’s Personal Data, taking into account the nature of any Personal Data and Federated’s purposes for processing that Data.
  3. Right to request deletion of Personal Data provided by or obtained about the Consumer.
  4. If Personal Data is available in a digital formal, obtain a copy of the Data that the Consumer previously provided to Federated in a portable and usable format.

Exercising Consumer Rights:

Consumers are entitled to exercise their rights at any time by submitting a:

and specifying the rights they wish to exercise.  Federated will respond to requests without undue delay and no later than the 45th day after receiving an authenticated request.  Federated may request an additional 45 days when reasonably necessary. Consumers will be notified of any extension and the reasons for it, either by mail or electronically, at the Consumer’s option.

Consumer requests will be responded to free of charge no more than twice annually, per Consumer.  Federated may charge a reasonable fee if a request is manifestly unfounded, excessive, or repetitive.

Federated will not comply with a request to exercise Consumer rights unless it can authenticate the identity of the requestor, using commercially reasonable efforts.  We may request that a Consumer provide additional information in order to authenticate the Consumer’s identity and request.

If Federated declines to comply with a request, it will notify the Consumer of the justification in writing and provide instructions on how to appeal.
